agency workers regulations
The Agency Workers Regulations are one of a series of initiatives devised by the
EC to ensure that all workers are employed on equal terms. In November 2008 the
Temporary Agency Work Directive was formally adopted by the European Council with
agreement that it will be implemented by member states no later than Dec 2011. Here
in the UK the regulations came into force 01/10/11.
Also known as “the equal treatment principle”, the purpose of the Agency Workers
Directive is to ensure that the principal of equal treatment applies to temporary
& agency staff in terms of basic working & employment conditions. The regulations
do not apply to workers who are self-employed or working through their own limited
liability company.
Subject to a relevant qualifying period, which has been set at 12 weeks in the UK,
agency workers will enjoy the same terms & conditions as if they had been recruited
directly by a company.
